BELLEFONTE, Pa. (AP) – The lawyer for a Penn State fraternity president accused within the demise of a pledge after an evening of consuming and hazing says his shopper did not see something to make him assume the pledge was susceptible to dying.

Protection lawyer Frank Fina argued at a preliminary listening to Wednesday that there is no proof that former Beta Theta Pi president Brendan Younger acted maliciously the night time 19-yr-previous Tim Piazza of Lebanon, New Jersey, was fatally injured.

He says Younger’s complete publicity to Piazza’s consuming lasted solely 12 seconds.

However Centre County District Lawyer Stacy Parks Miller says Younger was “answerable for the fraternity” and despatched texts afterward indicating he was accountable.

A district decide has to determine whether or not to ship the case towards Younger and 15 others to trial.
